Abstract

"Politics and Other Mistakes" piece on a Maine Supreme Judicial Court ruling that indicates Ethan K. Strimling never had a legal right to claim the at-large Portland City Council seat he tried but failed to take from incumbent Philip J. Dawson in the city's May 4 elections. In 1994, Supreme Court justice Kermit Lipez ruled that a candidate in a Republican primary race could not claim a ballot on which the voter checked only the block next to the write-in candidate's space, even though her name appeared immediately above the mark. The article questions what Strimling and his lawyers knew about the 1994 ruling, and when they knew it.
