Terry Sawtelle, 31, the former owner of Herbal Tea and Tobacco at several locations in Portland, sells exotic pipes and other items that most law enforcement officers refer to as drug paraphernalia. Portland police confiscated Sawtelle's stock in 1998, but last year a judge ordered the police to return the merchandise to Sawtelle because it was not in use when seized and its mere existence does not make it illegal and contraband. In February, Sawtelle and his girlfriend, Dusty Gay, opened a new store in Saco called 420. And on May 2, Saco police seized his inventory. Now Sawtelle plans to reopen his shop in Portland.
