David Fleming is serving an 80-year sentence for the 1990 rape and murder of Lisa Garland of Bangor. William Maselli of Auburn, Fleming's attorney, has asked the Maine Supreme Judicial Court to overturn his client's conviction, because of its reliance on DNA evidence. Maselli argued in favor of eliminating DNA evidence altogether. The court could overturn Fleming's conviction and bar the use of DNA evidence, uphold the use of DNA evidence in this case, or establish broader guidelines for the use of DNA evidence in future cases.
