Abstract

"News" piece on a recent Maine Supreme Judicial Court decision that threatens to drive up the cost of workers' compensation insurance, according to business and insurance groups. The Feb. 6 decision, consolidating the cases of Arthur Kotch v. American Protective Services and Donald Wheeler v. Hartt Transportation Systems, incorporates pre-existing conditions into the formula for determining injured worker benefits in Maine. Allan Muir, an attorney for the Maine Employers' Mutual Insurance Company, said if the decision stands, old football injuries and chronic conditions could be stacked on workplace injuries as a way to secure long-term benefits.
