Abstract

U.S. District Court Judge Morton A. Brody has ruled that the law enforcement officers who shot Katherine Hegarty in May 1992 are not entitled, under federal law, to the immunity that surrounds officers acting in an official capacity because their actions were so far from accepted practice. A 1993 state law that provides for blanket immunity means the officers cannot be prosecuted under state law. Details.
