Abstract

"Perspectives" piece outlining the effect of a recent decision by the U.S. Supreme Court, which will mean that an employer can be liable for age bias if a personnel policy negatively impacts workers over 40, even in the absence of discriminatory intent. Historically, the Age Discrimination in Employment Act has provided less generous protections for these workers than those aimed at other classes of workers, such as minorities. Maine has the oldest average population of any state, making this issue especially relevant.
