Abstract

The Maine Legislature this session will consider as many as seven bills dealing with takings law. The 5th Amendment to the U.S. Constitution says the government should pay landowners if it takes their property, and since 1870 the Maine Supreme Judicial Court has considered 84 takings cases. Supporters of reform of the takings law say it will save property owners from government regulation, while opponents see reform as a backhanded way of undermining environmental, health and safety laws.
