Abstract

"Cover Story" piece on Brian Farrington, 39, of Minot, who filed a lawsuit against Bath Iron Works (BIW) last November. Farrington claims he was regularly harassed in the workplace because he is mildly retarded and his retardation is a disability that warranted protection under the 1990 Americans with Disabilities Act. The case against BIW and plant supervisors Steve Allen, Brian LeClair, Bob Lally and Rene Beliveau will address the legal definition of disability and the relevance of a perception of mental competence in the workplace. Last year, Maine's human rights commission received 348 disability related complaints out of a total of 1,110 complaints filed, although most involved physical disabilities. No date has been set for a hearing on Farrington's complaint by the U.S. District Court in Portland. With details about Farrington's complaints.
