Abstract

On August 10, Central Maine Power Co. (CMP) cut trees and brush and sprayed the hebicide Triclopyr on Tom Foote's land in Hiram, poisoning the grazing land for his three cows. Foote had informed a CMP contractor orally about his objections to having his land sprayed, but since he failed to fill out a form notifying CMP of his position the utility was under no obligation to negotiate an alternate method or notify him of the date they planned to take action.
