Abstract

The Maine Legislature in 1991 enacted the Dairy Stabilization Act, and in the three years since $6.5 million has been returned to the state's dairy farmers. A recent decision by the federal 1st Circuit Court ruled the Act unconstitutional, prompting state Attorney General Michael Carpenter to say that it is up to the state Legislature to craft legislation that is both fair and beneficial to dairy farmers. The milk tax generated around $5,000 annually for a farmer with 50 cows, and contributed to Maine losing only 64 dairy farms since 1991, the lowest rate in New England. Details.
