Abstract
"City" piece on an attempt by the Portland Coalition for the Psychiatrically Labeled to prevent people from smoking in front of their building. Charles Maxwell, a former member of the coalition board and a client, says sidewalks are public property and it's unconstitutional for a private organization to impose a no-smoking ban on public property. Charles Lane, an attorney with the city of Portland, agreed, but he cautioned that the proportion of sidewalk owned by the city and by individual building owners varies greatly and a boundary survey would be needed in each case.
