Abstract
"Capitol Update" piece on efforts to clarify the definition of an employee, a confusing issue due to differing definitions used by Maine State Revenue, the Workers Compensation Board, and the Unemployment Commission. Governor LePage eliminated the Employee Misclassification Task Force set up by Governor John Baldacci and approved a new study group, made up of worker and employee representatives, to create a uniform definition of an employee by January 2012. Employers who incorrectly treat workers as independent contractors instead of employees result can avoid payroll taxes and workers' compensation payments, leading to losses of at least $36 million per year in state tax revenue.
