Abstract

"Capitol Update" piece on Maine Revenue Services interpretation of current law that allows them to tax prepared food that includes medical marijuana at a 7% state sales tax rate. Medicine is normally exempt from sales tax and this new rate is higher than the 5% sales tax rate for medical marijuana set by lawmakers. Peter Beaulieu, director of the Sales, Fuel, and Special Tax Division at MRS, said that any changes to the taxation rate of prepared foods with medical marijuana would need to be made by the Legislature.
