Abstract

Penobscot County Superior Court justice Andrew Mead ruled this week that jurors hearing the case of David Fleming, 35, should be able to consider DNA evidence. Fleming, currently serving an 80-year prison term for the 1991 kidnap, rape and attempted murder of a 15-year-old York girl, is charged with murder in the death of Lisa Garland, 18, whose body was found in Alton in November 1990. Previous cases that involved DNA tests have ended either in guilty pleas or acquitals. Details.
