Abstract

The Maine Supreme Judicial Court yesterday denied an appeal by Charles FitzGerald of Atkinson, whose attempt to purchase 61,000 acres of timberland in northern Maine from Occidental Forest Inc. fell apart when he failed to get financing in time. FitzGerald in 1988 paid $1 million for a purchase option on the acreage, and forfeited the money when he was unable to secure the $27 million for the purchase by the contract deadline. The court decided the case solely on procedural issues, and did not address the merits of the dispute.
