Abstract

Cecile Brown of Scarborough has filed suit in Cumberland County Superior Court against Tinamarie and Gordon Smith, who say that Brown's rock garden and driveway are on the land on which they are building a new home. Construction of the home has resulted in heavy vehicles tearing up Brown's lawn, and Superior Court justice Leigh Saufley has issued a temporary restraining order barring contractors from disturbing the rock garden or Brown's driveway. Brown's attorney said a legal concept called "adverse possession" gives his client a claim to the land. Details.
