Abstract

The U.S. Justice Department has filed a legal brief saying that construction of Bangor Hydro-Electric Co.'s Basin Mills hydroelectric dam would violate laws guaranteeing the Penobscot Indian Nation fishing rights for the Atlantic salmon. The Penobscot River Coalition and the Penobscot Nation sued the Maine Board of Environmental Protection after it voted to certify the Basin Mills project. Part of the state's land claims settlement with the Penobscots guarantees them fishing rights, and restoration of the river's salmon fishery is highly unlikely if the dam is constructed. Details.
