Abstract

Maine established pre-litigation screening panels as part of the 1986 Tort Reform Act. The panel process is designed to make sure that malpractice suits against doctors are valid, and proponents argue the process is justified because medical malpractice actions are technical and complex. Attorneys for plaintiffs say the system discriminates against the person with a small claim. They have been unsuccessful in having the panel system abolished. Details.
