Abstract

Superior Court justice Donald Alexander yesterday upheld the Maine Board of Environmental Protection's approval of Bangor Hydro-Electric Co.'s Basin Mills hydroelectric project on the Penobscot River. The project, which is now being reviewed by the Federal Energy Regulatory Commission, was challenged by environmental and fishing groups. Alexander said the BEP took the proper steps to limit the effect on the river's salmon fishery, and rejected claims that a state law protecting rivers had been violated.
