Abstract

A Pennsylvannia district attorney said yesterday that he will seek the death penalty for James Cruz Jr., 36, if Cruz is convicted of the first degree murder of 17-year-old Dawn Marie Birnbaum. Birnbaum, who had runaway from a home in Poland, Maine, for troubled youth, was last seen alive at a Bangor truck stop. Cruz, a truck driver, is accused of having raped and murdered her before leaving her body along Pennsylvannia Route 26 in March.
