Abstract

The Cumberland Town Council will now have to decide whether to give police chief Leon Planche a new hearing to determine if he had been drinking on duty while working at the 1992 Cumberland Fair. Last year, Planche was dismissed from his job after a hearing conducted by Town Manager Benson determined that Planche had been drinking, but Justice Kermit V. Lipez recently ruled that because of Benson's possible bias against Planche, the chief is entitled to a new hearing and to $80,000 in backpay.
