Abstract

U.S. District Judge Morton Brody has ruled that the five police officers responsible for having killed Katherine Hegarty in her cabin in 1992 are not immune from prosecution because they "could not reasonably have believed their forcible intrusion into Hegarty's home was justified" by circumstances. Brody did rule, however, that the officers' supervisors are immune from the lawsuit filed by Hegarty's husband, Jack.
