Abstract
A U.S. Court of Appeals two weeks ago ruled that Maine's vendor's fee, added to the price of milk when the price paid to farmers dropped significantly, was unconstitutional. The fee, created in 1991, subsidized farmers by stabilizing prices, and represented around 15 percent of a farmer's disposable income. The court viewed Maine's stabilization fund as similar to a Massachusetts pricing arrangement struck down by the U.S. Supreme Court, but Bernard Shaw, Maine's commissioner of agricuture, yesterday said the two programs are different.
