Abstract

U.S. District Court Judge D. Brock Hornby yesterday commented publicly on the recent jury ruling that resulted in a drunken driver receiving $75,000 because he ran into a police roadblock. Hornby said he believed the public outrage about the verdict was due to a misunderstanding of the jury's role, and explained that the jury ruled only on the narrow question of whether the roadblock was partial or full. The law pertaining to roadblocks says that a roadblock with no escape route is considered deadly force, and is improper to use in stopping a driver. Details.
